1. Eligibility
- You must be at least 18 years old, a resident of a state where we currently buy (New York or Texas), and the sole lawful owner of the items, with full right to sell them free of any lien, claim or security interest.
- You must provide your legal name, home address, phone, email, and a valid, unexpired government-issued photo ID, and keep that information accurate.
- We may decline any inquiry or purchase for any lawful reason, including inability to verify identity, ownership, or authenticity.
2. How the process works
- Inquiry. You submit an online inquiry with photos of the items and your ID. Online estimates are calculated from the published per-gram rate and the purity and weight you enter. An estimate is not an offer to purchase.
- Mail-in only. We currently buy by mail only. Do not ship anything until we approve your inquiry and email you a prepaid, insured shipping label. Items must be shipped to the address on that label, our processing facility in Texas. Items sent without our label are sent at your own risk.
- Card authorization. Before we issue a label, you authorize a credit or debit card through our payment processor's secure link. We never see or store your full card number. See section 5 for when it may be charged.
- Receipt and verification. On receipt, we record the package opening on video, weigh items on a legal-for-trade scale, and test purity using methods such as X-ray fluorescence (XRF), acid or electronic testing. Testing may require a small scratch or file mark on an inconspicuous area of the item. You consent to this testing.
- Final offer. We email a written final offer based on verified weight and purity, at our per-gram rate in effect when the offer is made. Gemstones, pearls, enamel, steel springs, solder and other non-precious materials are deducted and not paid for. Offers are valid for the period stated in the offer email (default 48 hours) because metal prices change.
- Acceptance and payment. If you accept in writing (including by email or clicking accept), title to the items passes to Fuse Bullion when we send payment. You are paid only after verification and acceptance, by your chosen method: ACH bank transfer, business check, Zelle, or a swap for bullion or Fuse Jewelry credit. We aim to send payment within 2 business days of acceptance.
- No response. If you neither accept nor decline within 10 days of the offer, we will contact you; if we still can't reach you after 30 days, we will return the items to your address on file under section 5.
3. Payout rates and the "best published payout" statement
Our per-gram rates are published on our website and update with the spot price about every 5 minutes. "Best published online payout" means the highest payout rate we found published by a U.S. online mail-in gold or silver buyer, applied to the current spot price; we set our gold rates 10 cents per gram and silver rates 5 cents per gram above it. Payouts are per gram of total item weight at the tested purity. Bullion is paid at a stated percentage of melt value.
4. Insurance and risk of loss
Packages shipped with our prepaid label are insured from carrier acceptance until delivered to our facility, up to the declared value on the label, which is based on your estimate. Our liability for loss is limited to the melt value of the items as described in your inquiry, as verified by insurer claim processes. Items in our possession are insured until paid for or returned.
5. Declined offers, items that are not genuine, and the return fee
- If you decline our offer, or any item is found not to be genuine gold or silver of a recognized purity (for example, plated, filled, counterfeit or base metal), we return the items to your address on file by insured shipping.
- In either case, you authorize us to charge the card you authorized a $25.00 handling fee plus the actual cost of insured return shipping. We will email you the amount before charging. We never charge the card if you accept our offer.
- If items appear stolen or are the subject of a law enforcement hold, we will report them and hold them as required by law. They will not be returned, paid for, or charged a return fee while a hold is in effect.
6. Your representations
You represent that the information you give us is true and complete; that you own the items and they are not stolen, borrowed, pledged or subject to any claim; that you are not acting for anyone else unless you tell us; and that you are not a person on any U.S. sanctions list. Providing false information to a precious metal dealer may be a crime.
7. Identity, records and reporting required by law
- As a precious metal dealer, we are required to collect and keep your identifying information, a description and photographs of each item, and transaction details, and to report purchases to law enforcement where required. In Texas, purchases of crafted precious metal are reported to local law enforcement and held for the period required by Texas Occupations Code Chapter 1956 (currently at least 11 days after the report is filed) before they can be melted or resold; a peace officer may place a hold of up to 60 days.
- We maintain an anti-money-laundering program under the Bank Secrecy Act and may request additional information or decline transactions. We screen sellers against U.S. sanctions lists.
- Certain bullion purchases are reported to the IRS on Form 1099-B as required by law, which may require your taxpayer identification number. You are responsible for any taxes on your sale.
- How we store and protect your ID is described in our privacy notice.
8. Electronic records and signatures
You agree that this agreement, your inquiry, offers, acceptances and notices may be provided and signed electronically and have the same effect as paper documents with handwritten signatures, under the federal E-SIGN Act and the Texas Uniform Electronic Transactions Act. We record the date, time, IP address and agreement version when you accept.
9. Limitation of liability
To the fullest extent allowed by law, our total liability arising from any transaction is limited to the greater of the final offer amount or the verified melt value of your items. We are not liable for sentimental, artistic, collectible, gemstone or appraisal value; if an item may be worth more than its metal, consider selling it elsewhere.
10. Governing law and disputes
This agreement is governed by the laws of the State of Texas, without regard to conflict-of-law rules, except where the law of your state of residence must apply. Before filing any claim, you agree to contact us at [email protected] and try to resolve the dispute informally for 30 days. Nothing here limits rights you have under consumer protection laws that cannot be waived.
11. Changes
We may update this agreement. The version you accepted with your inquiry applies to that transaction.
